Josh Duggar Claims Child Porn Guilty Verdict ‘Unconstitutional’

On December 9, a two-week trial focusing on Josh Duggar’s child pornography allegations resulted in a guilty verdict. Ever since, Duggar has been behind bars awaiting his sentencing hearing. But now Josh has come up with a new way to avoid a lengthy prison stay. He claims that the guilty verdict appears “unconstitutional” in his revised defense, reported the Sun.

Previously, Duggar’s lawyers had filed other attempts to get the 33-year-old “19 Kids And Counting” alum out of jail. For instance, the attorneys tried to argue that the child pornography charges should get dismissed. But prosecutors called evidence of Josh’s guilt “clear and overwhelming.”

As a result, Duggar’s attorneys looked for a different option. “This is the rare case where a criminal defendant was deprived of significant constitutional rights and the law requires a new trial,” claimed the lawyers in the new filings. And they also claimed that the government had unfairly responded to Josh’s pleas of innocent, making it all “unconstitutional.” 

Can Josh Duggar Avoid Sentencing With New Plea?

Prosecutors have repeatedly battled Josh Duggar’s attempts to avoid a lengthy jail stay. For instance, Josh argued that the jury saw “no evidence that Duggar personally viewed any specific portion of any of the files allegedly found on the computer.” But prosecutors responded by noting that they had shown that Josh “knew the material was of minors engaging in sexually explicit conduct.”

In addition, Duggar’s lawyers feel that the government did not present all the evidence needed for reasonable doubt. That evidence included an employee who also could use that computer on which the child pornography got downloaded. As a result, Josh’s attorneys feel that investigators “failed to meaningfully investigate the possibility that anyone other than Duggar may have committed the crimes charged.”

But prosecutors responded that blaming another employee represents “pure fiction” for a simple reason. That worker did not live in Arkansas at the time that the child pornography files got downloaded. In their response, though, Josh’s team blamed the government for playing games to avoid further investigation.

If Josh’s lawyers do not succeed with any of their attempts, Duggar could spend 20 years in prison for each of the guilty two counts.
