Jesse Weber opened Wednesday’s episode of Sidebar on the Law and Crime Network with updates on singer David Burke, who performs under the name D4vd.
The Status Hearing
D4vd returned to a Los Angeles courtroom for a status hearing. Most true crime fans already know that he’s charged with first-degree murder, continuous sexual abuse of a minor under 14, and mutilating human remains.
But if you are not aware, the case revolves around the death of 14-year-old Celeste Rivas Hernandez.
The Prosecution Stance
A ccording to prosecutors, Burke had an illegal sexual relationship with the victim. Jesse recapped the case, reminding true crime followers that according to state allegations, he enticed her to an LA rental property on April 23 last year.
David Burke allegedly stabbed Celeste Rivas Hernandez and watched her die. The prosecution argues that D4vd wanted to protect his music career by keeping her quiet.
It seems like a steep price for a career. The charges carry severe penalties, including a potential death sentence, because of special circumstances like lying in wait.
Disturbing Evidence & Disposal Methods
Investigators claim Burke bought chainsaws, an inflatable pool, and heavy laundry bags to cut up and hide the body.
He also allegedly lied to friends about the foul smell in his home.
On September 8 last year, workers found her remains inside a Tesla registered to Burke at a local tow yard.
Detectives opened the front trunk and found an insect-infested bag containing a decomposed head and torso. A separate trash bag held her arms and leg. Her ring and pinky fingers were missing.
Administrative Investigation & Leaks
The graphic details led to an administrative investigation. Jesse cited an NBC News report that revealed more than twelve employees at the LA County Medical Examiner’s Office underwent some scrutiny because they allegedly looked at case files without permission.
According to several accounts, the leak of autopsy details before official publication likely triggered the human resources inquiry.
The employees’ union stated, “We expect the county to conduct any investigation professionally, fairly, without prejudice.”
Another labor group affirmed they are “firmly committed to safeguarding the privacy of all victims.”
Tension Between Agencies
Jesse Weber explained that tension between agencies complicated the original investigation.
It seems that the information is new and apparently, the LAPD Robbery-Homicide Division wanted a hold on the records. But, the medical examiner refused. Remember, a court did seal some files back in November.
Chief Medical Examiner Dr. Ode Akbo complained about law enforcement holds, saying they are “virtually unheard of in other counties.”
The police force argued that they needed to protect their investigation and needed to avoid leaks. That accounts for why the autopsy results only arrived in late April this year.
The Autopsy
From the standpoint of Dr. Akbo, he felt that things went on way too long for the family of Celeste Rivas Hernandez.
Jesse Weber reminded folks during his monologue that the autopsy revealed that Celeste had at least “two penetrating wounds of the torso.”
Another cut hit the liver of the victim and more damage was observed on her chest and ribs.
Severe decay obscured other potential tissue injuries.
Updates From The Court
Reporter Julia Deng provided updates from the courtroom. Burke did not look his best. He wore an orange jail uniform, had longer hair, and remained unshaven.
Per Julia, he appeared alert and smiled while greeting the judge.
After many long delays, the judge finally scheduled the preliminary hearing for D4vd for Tuesday, July 21.
At the hearing, the prosecution will need to show that they have enough evidence for a full trial. Both sides have now shared all relevant discovery material.
No family members or friends attended the session. The judge signed a new protective order to shield specific case data from public view.
Additionally, the defense requested transcripts from prior grand jury panels.
Behind-the-Scenes Friction & Next Steps
Deng noted deeper procedural issues behind the scenes. Days passed between Burke’s initial arrest and formal charging, suggesting friction between the police and the District Attorney.
Early claims that Burke cooperated with the LAPD also fell apart when a captain publicly disputed the narrative. His defense is now actively contesting the case as it moves toward the preliminary hearing.
