Heather Mashburn-Smith, the 37-year-old former English teacher at Port Charlotte High School in Florida who admitted to intimacy with a student, quickly entered a guilty plea. Read on for more details.
Pleading Guilty
After her arrest on April 29 this year, she was set for a standard case management hearing on August 25. However, the hearing ended up finalized as the former teacher entered a guilty plea.
She was sentenced after she pleaded guilty to unlawful intimate activity with certain minors, which was upgraded to a first-degree felony due to her role as an educator. The charge carried a maximum potential prison sentence of 30 years.
The Final Sentence
The plea agreement meant that she avoided a long trial and also avoided the possibility of spending decades in prison.
According to Gulf Coast News, Mashburn-Smith pleaded guilty and “was sentenced to seven years in state prison.” She also got a lifetime ban from teaching.
The Notification
An affidavit revealed the relationship began over Snapchat after a student complimented her. The encounters allegedly involved unprotected intercourse on school grounds over a period of four to five weeks.
The school administration learned about the alleged conduct through an alert submitted using a parent app. It came after the student tried to end the relationship, but Mashburn-Smith allegedly continued making advances. She reportedly told him she would leave her marriage when he turned 18 so they could be together.
Recent bodycam footage brought renewed interest in the case by true crime followers. In the footage, she was remarkably cooperative with officers and explained the area where the incident had happened.
Showing the Deputies
Apart from showing deputies the chairs and desks, and admitting to cleaning up with Clorox, Heather Mashburn-Smith also provided a personal notebook containing her feelings. The police seized the document under a search warrant.
Mashburn-Smith took them to a computer and showed them where she had archived deleted emails and explained that the reason she wanted the relationship was because the student made her feel desired.
Florida Law
Under Florida Statute 794.05, a person aged 24 or older commits a second-degree felony by engaging in sexual activity with a 16- or 17-year-old. Mashburn-Smith’s offense was reclassified as a first-degree felony because she was an authority figure employed by the student’s school.
Prosecutors emphasized that the law recognizes the imbalance of authority between an educator and a student.
Superintendent Mark Vianello and Sheriff Bill Prummell condemned the breach of trust, noting that educators are meant to mentor and protect students.
Mashburn-Smith was transferred to the Florida Department of Corrections.
