The TLC star refuses to give up. He petitioned the U.S. Supreme Court to appeal his prison sentence. Josh filed an appeal to shorten his sentence, but a judge tossed that out in September.

Josh Duggar's Possible Constitutional Reason For AppealJosh is currently serving a 12-and-a-half-year prison sentence. He was convicted in December 2021 of two accounts of receiving and possessing child pornography.

Josh was sentenced the following May. His lawyers filed an appeal to the Supreme Court, according to In Touch Weekly.

“Mr. Duggar’s case raises an important question, inter alia, concerning a criminal defendant’s constitutional right to present a complete defense,” Josh Duggar’s lawyer stated, according to the court documents.

According to the Counting On spoilers, the Supreme Court will have to determine whether they will listen to the reality star’s case. This could affect his release date.

However, only a small percentage of cases go to the Supreme Court. Josh’s current release date is set for October 2, 2023, per the Federal Bureau of Prisons database.
