Heather Mashburn-Smith, a 37-year-old English teacher at Port Charlotte High School in Florida, was arrested on April 29, 2026. She faces a charge of unlawful sexual activity with certain minors under Florida Statute 794.05, upgraded to a first-degree felony because of her job as an educator.
The charge carries a potential prison sentence of up to 30 years.
How It Began
According to the arrest affidavit, the issue began over Snapchat. A 17-year-old male student complimented her appearance on a group text, which led to flirtatious messages and meetings inside her classroom.
The student told investigators the encounters turned sexual for about four to five weeks, alleging they had intercourse twice in her classroom: once on a desk and once in a chair.
A Parent App Warning
Deputies showed up at the school after receiving a tip. Chris Stewart noted on Law&Crime Network’s On The Case that “deputies were called to the school because a message came in on an app.”
Stewart added that it was “an app that allows parents to communicate with school district staff and the message was allegedly about Mashburn having sex with a student.”
According to Fox News, the student revealed he tried ending things, but Mashburn-Smith “told him that she was not in a good marriage and that she wanted to leave her husband and be with him” once he turned 18.
The teenager blocked her afterward, though she allegedly kept trying to contact him on social media.
Admissions On Bodycam
Bodycam footage showed the teacher pointing out exact spots in her classroom to deputies. During the walkthrough, Mashburn-Smith pointed to furniture and agreed when a deputy asked whether she had wiped the desks down “with Clorox” after the alleged sexual activity.
She admitted to writing out her feelings about the teenager, telling officers “there’s nothing like graphic in it but it’s just like thoughts that I would write as if I were writing to him.”
Locating a folder, she told the deputies, “I really just want to throw it in the trash.” Deputies told her the folder would be seized under the search warrant.
The Emails
Chris Stewart remarked that “Mashburn is being very forthcoming with officers, even with messages she says that she deleted from her computer.”
She then logged onto her computer and showed deleted emails on a screen for deputies.
According to The Mirror, Mashburn-Smith told police during her post-Miranda interview that the student made her feel “special and desired.”
Case Management Hearing
Following her arrest, Mashburn-Smith was held without bond at the Charlotte County Jail. Online court records show she has a case management hearing scheduled for August 25, 2026.
Charlotte County Public Schools Superintendent Mark Vianello condemned the incident, saying, “The actions of this individual are a direct violation of the duty every educator owes to students and families. We will not tolerate anything that compromises student safety.”
He confirmed she was placed on administrative leave.
Charlotte County Sheriff
Charlotte County Sheriff Bill Prummell praised his team’s fast work, stating, “What this woman has done is not just unlawful, it is damaging to the students and staff around her.”
He added, “This individual took advantage of that vulnerability and preyed on one of the people she was entrusted to protect.”
