Tyler Robinson: Legal Challenge Could Delay Charlie Kirk Assassination Case

An important legal twist emerged in the case of Tyler Robinson, accused of assassinating Charlie Kirk. Notably, it could change how the courts handle the prosecuting team. Read on to find out more about a potential conflict of interest.

The Conflict Of Interest

On Friday this week, Brian Entin and defense counsel Clayton Simms discussed the problem on NewsNation. Notably, it could have contaminated the prosecution’s case.

Simms believes that the issue should be taken very seriously because it involved a family member of one of the prosecutors. Simms explained that one of the witnesses, a relative of a prosecutor, was at the shooting.

“The person who witnessed the shooting sent text messages as it went down,” Simms said. “And shortly thereafter, those communications were shared.”

Additionally, he pointed out that the messages about the alleged killing of Charlie Kirk by Tyler Robinson passed through the office until they arrived at the “top” of the prosecution office.

The Defense Will Use That Information

Basically, the defense will allege that the prosecution should have first heard about the details of the assassination and the suspect through official channels. Instead, it came from a private, informal source who had a personal connection.

According to Simms, that puts the state in a difficult situation. “The problem was that it was widely shared,” Simms said. Because the information was sent “all the way to the top,” he thinks that the conflict is serious and “not going to go away.”

What Might The Judge Do?

The judge handling the case could take several different courses of action. They could reject the motion and allow the prosecution to go on. Another option might be to remove from the case the specific attorney who was the recipient of the texts.

Alternatively, the judge could follow the defense’s lead in removing the county attorney’s office from the case entirely. Obviously, the last alternative would have a huge impact, as a new team would need to step in, and that would potentially delay the case for along time. 

Facing The Death Penalty

Tyler Robinson was identified as a suspect, and after a lengthy manhunt, police took the 22-year-old from Washington, Utah, into custody in September 2025. Then, they charged Tyler Robinson with the murder of conservative activist Charlie Kirk at Utah Valley University.

Prosecutors announced their intention to seek the death penalty, which could involve a firing squad, in connection with the charge of aggravated murder. For the next several weeks, all attention will be on this legal battle over procedure.

True crime followers responded to the report, but notably, it’s very divisive because of the political ramifications. Some folks point to the many tin-hat theories that arose. And, that was reflected in the discussion. One person opined that “This was a PSYOP.”

Meanwhile, others can’t understand how such a conflict of interest would even happen. A person noted that it seemed “unreal.” Meanwhile, another viewer opined that the whole thing was all based on “NOTHING—just rumor.”

A preliminary hearing is set for January 16. Originally, a family member claimed that Tyler had been a conservative supporter, but he changed and talked about hating Charlie Kirk’s statements, believing they were “full of hate.”
