The Lindsay Clancy case is back in the news as the prosecution filed paperwork that suggests they will go for a retrial over the deaths of Cora, 5, Dawson, 3, and Callan, 8 months old. While the court documents didn’t say they want a retrial, they did say the prosecution wants to “pursue justice.”
The Next Hearing
Kevin Reddington already filed a motion to dismiss the charges against Lindsay. His argument is that retrying her would raise double jeopardy concerns, based on the position taken by the sole holdout juror, Michael P. Desronvil.
Reddington’s efforts to get Desronvil’s cell phone records checked were unsuccessful, which was another blow for the defense team. Reddington doesn’t want Lindsay to face another trial, but he might not get his way.
The next hearing on whether Lindsay will stand trial again is scheduled for November 2.

Patrick Clancy has a civil case against the doctors who treated Lindsay. Per CBS Boston on YouTube, Patrick’s case was in court on Wednesday this week “for the first time.” Lindsay also has a separate civil case pending.
Patrick Clancy claims that the health providers didn’t effectively treat his wife and that this contributed to her actions that caused the deaths of their three children. According to Howard Cooper, Patrick’s lawyer, Lindsay might testify in Patrick’s case.
The outlet noted that “Patrick Clancy was not present at the hearing as lawyers for Lindsay’s doctors argued the judge should dismiss the case.”

True crime followers who saw the report on YouTube discussed both cases. With the possible retrial of Lindsay, some folks think it should go ahead. One of them wrote, “Please just say you will retry her. Those kids should be alive and thriving.”
Another one said, “If i was defense i would cop a plea. That lady is in hot water with the general public.”
While Lindsay’s case was controversial because she didn’t deny killing her children, the civil case might also attract a lot of attention.
Reacting To The Civil Case
Patrick Clancy is also taking some heat from viewers who believe he should have done more after learning about his wife’s struggles.
One person wrote, “Why didn’t he keep his kids away from his wife after she told him she had homicidal thoughts? Yet he’s suing the doctors? Hypocrisy.”
During Lindsay’s original trial there was a lot of talk about her mental health, and medications were discussed. So was the fact that her sister and mom testified she’d spoken about self-harm.
According to The Boston Herald, the civil case involves Dr. Jennifer Tufts and a nurse practitioner, Rebecca Jollotta who claimed during the trial that Lindsay hadn’t told them “she had thoughts of harming her kids.”
Their respective organizations, South Shore Health and Aster Mental Health, are also named in the civil case brought by Patrick Clancy.
